Burris Determined To Take His Seat Tuesday, Maintains That He’s A Senator

WASHINGTON — Barack Obama’s appointed successor declared Tuesday he’s qualified to take a seat in the Senate and said he’ll go to Capitol Hill to do just that.

“I’m presenting myself as the legally appointed senator from the state of Illinois. It is my hope and prayer that they recognize that the appointment is legal,” Roland Burris said in a nationally broadcast interview just hours before the Senate convenes with the start of the 111th Congress.

Burris dismissed the Senate Democratic leadership’s position that he cannot be seated because he was appointed by a governor accused in a criminal complaint of trying to benefit financially from his authority to fill the seat that Obama vacated after winning the presidential election.

“As I read the U.S. Constitution,” he said on CBS’s “The Early Show,” it says the “governor shall fill a vacancy, and as a former attorney general of my state, I have no knowledge of where a secretary of state has veto power over a governor carrying out his constitutional duties.”

Burris also maintained that the announcement by Gov. Rod Blagojevich Monday of a date for an election for a successor to Rep. Rahm Emanuel, D-Ill., proves the governor still has legal authority to carry out his duties. Emanuel will be Obama’s White House chief of staff.

“There’s nothing wrong with Roland Burris and there’s nothing wrong with the appointment,” Burris said.

Burris has found little support among fellow Democrats.

The Senate was scheduled to convene at noon Tuesday with its newest members. Yet the controversy over the appointment and the ongoing dispute over election results in Minnesota practically guaranteed that both seats would remain empty by day’s end.

Senate Majority Leader Harry Reid, D-Nev., said Monday that Burris would not be permitted to take his seat because Burris “has not been certified by the state of Illinois,” a reference to incomplete paperwork that only touches on the dispute. Senate Democrats maintain that Burris’ appointment is tainted because of the charges against Blagojevich.

While Blagojevich has signed formal appointment papers, Jesse White, the Illinois secretary of state, has not, and Senate rules require that signature. Burris, in turn, has gone to court hoping to win an order for White to sign the necessary paperwork, and he has also threatened to sue to take his seat in the Senate.

Burris, 71, declared, “I’m a United States senator” before leaving Chicago for Washington. However, he is not and cannot be a senator unless he is administered the oath of office.

In spite of his stance, Burris told reporters that he would not make a scene at the Capitol. He was to meet privately on Wednesday with Reid.

Some of Burris’ supporters have bemoaned the fact that Democrats would stand in the way of the Senate gaining its only black member. Burris himself downplayed the issue of race, telling reporters: “I cannot control my supporters. I have never in my life, in all my years of being elected to office, thought anything about race.”

Years and years ago, back at my old school, I participated in those weekly football pools — you know, just the kind where you pick each game based on the spread, toss $10 in the hat, and whoever correctly picked the most won for the week. We also had a champion for the best overall record, and the playoffs. This, of course, was back when there were only 14 games and no bye-weeks, so we’re obviously talking pre-personal computers, pre-internet, pre-ESPN, etc. You know — old school.

Nothing shocking there, just old-fashioned luck and maybe some hard work reading the newspaper for the up-to-date lines and injury reports. A good week was going 10-4, maybe 11-3, but those were few and far between. But…there was one girl who was constantly outperforming everyone else — we’re talking 13-1, 12-2, 11-3 every week. And she wasn’t even a football fan! It had to be more than just dumb luck. Turns out, she had an amazing strategy she didn’t reveal until the season was over.

And so, today, we’re going to apply her strategy of picking the NFL Playoffs using her technique. She picked the teams based solely on their helmet logo or name/(nickname) and how one team’s logo/mascot/name would do if it were living and breathing, and how that would fare if placed in battle against the other team’s logo/mascot/name in a pitched battle.

Forgive me for making this sound more complicated than it was…it was really as simple as this: Take the Giants versus the Cowboys. Helmet logos back then were kind of equal. So her deciding factor would be to take an actual giant doing battle against a cowboy. No contest, right? The giant wins. So she applied this formula to each and every game, picking against the spread. Sounds easy. But what about those teams that didn’t so easily translate into “things” that could do battle, like an oil rig versus nothing? Well, some logo has to trump no logo.

She’d always come up with imaginative ways to pick other games too, but it was still based on the “bigger or badder beats smaller or wimpier” philosophy. What about a bear versus a lion? Might be a tossup in nature, but the lion on the lid trumped the “C” on the bucket.

(CNN) — The man tapped by Illinois’ embattled governor to fill an open U.S. Senate seat will be turned away if he arrives for Tuesday’s inauguration of new members, according to two Democratic aides.

Roland Burris, Illinois Gov. Rod Blagojevich’s pick to fill President-elect Barack Obama’s vacant Senate seat, will not be allowed on the Senate floor, according to the aides — one who is familiar with Senate Democratic leaders’ plans, and the other an aide to the Senate Democratic leadership.

Democrats in the Senate have twice this week said they have the authority to refuse to accept anyone appointed by Blagojevich, who was arrested December 9, accused by federal authorities of corruption, including allegedly trying to sell Obama’s seat for personal gain.

Blagojevich, who denies wrongdoing and has ignored calls to resign, named Burris — a Democrat and a former Illinois state comptroller and attorney general — to serve the last two years of Obama’s Senate term.

The first Democratic aide said if Burris tries to enter the Senate chamber on Tuesday, the Senate doorkeeper will stop him. If Burris were to persist, either trying to force his way onto the Senate floor or refusing to leave and causing a scene, U.S. Capitol police would stop him, the aide said. "They [police] probably won’t arrest him," but they would call the Senate’s sergeant-at-arms, the aide said.

Burris has indicated he intends to be at the Senate on Tuesday. When asked about what would happen if he shows up, Burris told the Chicago Tribune that he is "not going to create a scene in Washington."

"We hope it’s negotiated out prior to my going to Washington," he added, according to the Tribune.

Burris told CNN that he was "certainly going to make contacts with the leadership to let them know that the governor of Illinois has made a legal appointment, and that I am currently the junior senator for the state of Illinois."

"And we’re hoping and praying that they will see the reason in appointing me as a very qualified, capable, able and ready-to-serve individual," Burris said.

The Senate sergeant-at-arms, Terrance Gainer, served in the Illinois government at the same time as Burris. Gainer was the director of the Illinois State Police from 1991 to 1995 — the same years Burris was the Illinois attorney general.
